EU & UK Website Privacy Notice

Our Commitment To Privacy

This European Union “EU” and United Kingdom (“UK”) Privacy Notice (“EU & UK Website Privacy Notice”) supplements the Privacy Policy with respect to additional information as required by applicable EU and UK data protection laws, including Regulation (EU) 2016/679 (the “EU GDPR”), the UK equivalent of the EU GDPR (the “UK GDPR”) and the Data Protection Act 2018 (together, the “EU & UK Data Protection Laws”).

To the extent that EU & Data Protection Laws apply to our processing of your personal data, Cogenuity will be a “controller” of your personal data. In simple terms, when applicable, this means we: (i) “control” the personal data that we collect from you or other sources; and (ii) make certain decisions on how to use and protect such personal data.

Any Additional Personal Data We May Collect

We do not collect any special categories of personal data about you (this includes details about your race or ethnicity, religious or philosophical beliefs, sex life, sexual orientation, political opinions, trade union membership, information about your health and genetic and biometric data), although there may be limited circumstances where we need to collect this type of personal data, or it is collected incidentally (e.g., via our use of CCTV systems). Nor do we collect any information about criminal convictions and offences.

Further information about the types of personal data that we collect and how we use them are set forth in the “Information We Collect” section of the Privacy Policy.

How We Use Your Personal Data And Our Legal Basis

We rely on various legal bases under the EU and UK Data Protection Laws in order to process your personal data, as we have set forth in the section titled “How We Use Your Personal Information” in the Privacy Policy.

We may also process personal data for any other purpose that has been notified to you, or that has been agreed in writing with you.

We will only use your personal data for the purposes for which we collected it, unless we reasonably consider that we need to use it for another reason and that reason is compatible with the original purpose. If we need to use your personal data for an unrelated purpose, we will notify you and explain the legal basis which allows us to do so.

If we require your personal data due to a legal requirement or obligation or in order to perform a contract with you, we will make you aware of this at the time we collect your personal data, and the possible consequences of you failing to provide this personal data. Failure to provide this information means that we cannot provide our services or products to you. In this case, we may have to cancel a product or service you have with us, but we will notify you if this is the case at the time.

Disclosure And Transfer Of Personal Data

We may share your personal data, where permitted by EU & UK Data Protection Laws, with our affiliates and certain service providers as necessary to fulfil the purposes set out in the Privacy Policy.

Your personal data may be transferred to, and stored at, a destination outside the EEA which may not always have data protection laws providing equivalent protection. In such case, we will take steps to ensure that your information is protected by appropriate organizational and security measures, and that any such transfers are done using specific legally approved safeguards. For further information about the safeguards/derogations used, please contact info@cogenuity.com.

Your Rights

Under certain circumstances, by law you have the right to access personal data we maintain about you, and there are several ways you can control the way in which and what personal data we process about you.

  • Access: You have the right to ask for a copy of the personal data that we hold about you free of charge, however we may charge a ‘reasonable fee’, if we think that your request is excessive, to help us cover the costs of locating the information you have requested.
  • Correction: You may notify us of changes to such your personal data if it is inaccurate or it needs to be updated.
  • Deletion: If you think that we shouldn’t be holding or processing your personal data anymore, you may request that we delete it. Please note that this may not always be possible due to legal obligations.
  • Restrictions on use: You may request that we stop processing your personal data (other than storing it), if: (i) you contest the accuracy of it (until the accuracy is verified); (ii) you believe the processing is against the law; (iii) you believe that we no longer need your data for the purposes for which it was collected, but you still need your data to establish or defend a legal claim; or (iv) you object to the processing, and we are verifying whether our legitimate grounds to process your personal data, override your own rights.
  • Object: You have the right to object to processing, including: (i) for direct marketing; (ii) for research or statistical purposes; or (iii) where processing is based on legitimate interests.
  • Portability: If you wish to transfer your personal data to another organization (and certain conditions are satisfied), you may ask us to do so, and we will send it directly if we have the technical means.
  • Withdrawal of consent: If you previously gave us your consent (by a clear affirmative action) to allow us to process your personal data for a particular purpose, but you no longer wish to consent to us doing so, you can contact us to let us know that you withdraw that consent.
  • Lodge a complaint: You have a right to lodge a complaint to your local supervisory authority (as discussed below) if your privacy rights are violated, or if you have suffered as a result of unlawful processing of your personal data.

You may contact us at info@cogenuity.com if you wish to exercise any of the rights set forth herein. These rights are not absolute and in certain circumstances their exercise may not be possible, including when personal data must be maintained to comply with applicable laws.

We may need to request specific information from you to help us confirm your identity and ensure your right to access your personal data (or to exercise any of your other rights). This is a security measure to ensure that personal data is not disclosed to any person who has no right to receive it. We may also contact you to ask you for further information in relation to your request to speed up our response.

To exercise these rights, please contact us at info@cogenuity.com. We will respond to your request within one month of receipt of your request. In some cases, we may not be able to fulfil your request to exercise the right before this date and may need to request more time. Where we cannot provide a full response to you for any reason, we will let you know about this in our initial reply to your request.

Should you wish to lodge a complaint with regards to how your personal data has been processed by us under:

  • the UK GDPR and/or Data Protection Act 2018, please contact the UK Information Commissioner’s Office at https://ico.org.uk/global/contact-us; or
  • the EU GDPR, please contact your local supervisory authority.

We would, however, appreciate the opportunity to address your concerns before you approach the relevant supervisory authority, so please contact us in the first instance.

Outside of work, Sarah can usually be found exploring the redwoods or strolling along Ocean Beach with her dog, Fred—who has strong opinions against frisbees but will happily chase the occasional stick. A proud LSU Tiger fan, Sarah never misses a chance to cheer on her alma mater. She’s especially passionate about Women’s Gymnastics (the Uneven Bars and Vault are her personal favorites) and Football—strictly in that order.

Fun Fact
Growing up in New Orleans, Sarah played the clarinet in her high school band and marched in over two dozen Mardi Gras parades.

Daniel is a self-proclaimed swirling mix of contradictions – an executive with tattoo sleeves, a playlist of 90’s rap and showtunes, a homebody who has visited over 40 countries, and the social stamina of an introverted extrovert who still recovers from a big night by napping in his closet, despite being out of one since his 20s.

Fun Fact
Daniel’s snazzy-dressing labradoodle (who insists on always wearing a bandana) can trace his name, Link, to three different sources, each representing Daniel’s varied interests:

  1. Link from the Legend of Zelda (90’s era NES gold cartridge for the win!)
  2. Link Larkin – a character from Broadway’s Hairspray (he has seen well over 50 shows and invested in several)
  3. Linkin Park (one of Daniel’s favorite bands, not the Chicago suburb, which is far too cold for Daniel’s California sensibilities) – in fact, Link’s full name is “Linkin Bark”

University of Chicago Booth School of Business, MBA

Responsible for
Firm leadership and strategy, investment decisions & management, and investor relations

Personal Interests
Dan originally decided to skip college and chase his dream of becoming a professional tennis player. Armed with ambition (and his trusty 1986 navy blue 4Runner as a makeshift home), he hit the road. After a few months of competing, earning a whopping $750 in prize money (pre-tax, of course), and learning the true meaning of “living the dream,” Dan realized that maybe—just maybe—a college education could serve him well. A few phone calls later, Dan traded the pro tour for a spot as a student-athlete at Cal Poly, where his next chapter began.
